Tenancy Agreements

Maitland Walker are able to assist with a number of residential landlord and tenant matters including the creation of Assured Shorthold Tenancy Agreements (“AST”).

Letting a property

Tenancies allow individuals to occupy a landlord’s property subject to paying the agreed rent and adhering to any conditions contained within the AST.

To let a residential property in England there are many requirements that the Landlord has to adhere to under current legislation. These include a minimum EPC rating, a valid Gas Safety report for any gas appliances, a valid electrical test report, compliance with smoke alarms and Co2 detectors as well as providing your tenant with a ‘How to Rent’ booklet at the outset.

Repossession of tenanted properties 

AST’s are usually drawn up for a term of at least 6 months, after which time the landlord may request possession of the property without cause.

However, if the tenant is in breach of the agreement the landlord will be able to seek possession at any time.

A landlord has the right to seek possession under accelerated possession proceedings after the initial 6-month term as long as the tenant has been given notice of this, under Section 21 of the Housing Act 1988. The earliest this can therefore be served is after the fourth month of the tenancy agreement.
